worne is a marketplace operated by worne, inc. (“worne,” “we,” “us”). we connect verified creators with buyers and provide the cryptographic verification layer for every piece sold. we are not a content platform; we do not host adult content; we are not a payments processor.

you must be at least 18 years old to use worne. by using the site you represent and warrant that you are 18+ and that the information you provide is accurate. age verification is required before your first purchase. accounts found to belong to minors are terminated immediately.

you are responsible for keeping your credentials secure and for all activity under your account. notify us promptly of any unauthorized access. one account per person. you may not transfer your account.

every garment listed on worne originates from our warehouse and carries an embedded cryptographic chip (NXP NTAG424 DNA). each garment is shipped to a verified creator, worn by that creator through one or more logged sessions, and then sold to a buyer who verifies the chip on arrival.

two fulfillment paths exist:

• buyer-initiated. a buyer commits to purchase; we ship a chipped garment to a creator who wears it for the agreed sessions, then ships to the buyer.

• creator-initiated. a creator pre-purchases chipped inventory, wears it, then lists it for sale on the platform.

the chip on each garment is the source of truth for authenticity. every tap generates a unique unforgeable code verified against our records. we do not authenticate items not originated from our warehouse. if a chip fails to scan on arrival you may open a dispute (see § 09).

creators agree to:

• wear only garments issued or pre-purchased through worne;

• log each wear session via NFC tap honestly and promptly;

• not damage, alter, or transfer chipped garments outside the platform;

• ship sold pieces in the tamper-evident packaging we provide, within the timeframe shown on the order;

• provide accurate payout information and maintain a valid age verification on file.

buyers agree to:

• provide accurate shipping and payment information;

• complete age verification before the first purchase;

• tap the chip on arrival to confirm receipt within the order window; failure to confirm within 5 days of carrier-confirmed delivery triggers auto-release of payout to the creator;

• not resell items outside the platform (resale is supported on-platform; see § 11).

payment is processed through adult-friendly third-party processors (CCBill, Segpay). worne does not store full payment-card data. funds are held until the buyer confirms receipt of the verified item (or auto-release fires after 5 days from carrier-confirmed delivery). worne charges a platform commission of up to 20% of the transaction value and may collect a garment margin on each chipped item.

because of the personal nature of worn apparel, items are not returnable for change-of-mind. you may open a dispute if:

• the chip fails to verify on arrival;

• the tamper-evident packaging arrived broken or compromised;

• the item materially differs from what was listed (size, color, catalog details).

disputes are reviewed by our team using the full chain-of-custody record (chip events, shipping scans, session media). resolutions may include refund, replacement, or partial refund at our discretion.

you may not:

• use the platform if you are under 18;

• misrepresent your identity, age, or address;

• attempt to forge, copy, remove, or transfer chip identity;

• list items not originated from our warehouse;

• use the platform to harass, defame, or solicit other users;

• scrape, reverse-engineer, or interfere with the platform's operation;

• use the platform for any unlawful purpose, including trafficking, exploitation, or sale of restricted goods.

once you own a verified piece, you may list it for resale on worne. a creator royalty (typically 5–10%) is automatically deducted from the resale price and routed to the original creator. the chip and its provenance log remain queryable across all subsequent transfers.

the worne name, marks, site design, and verification system are the property of worne, inc. creators retain rights to media they upload (photos, video clips attached to sessions) and grant worne a non-exclusive license to display that media on the platform in connection with the relevant garment and listing.

worne is provided “as is.” we make no warranty that the site will be uninterrupted or error-free. our maximum aggregate liability for any claim arising from your use of the platform is limited to the amount you paid worne in the preceding 12 months, or USD $100, whichever is greater.

we may suspend or terminate accounts that violate these terms or applicable law. you may close your account at any time by contacting us; outstanding orders complete under the original terms.

we may update these terms as the product evolves. material changes will be announced via email or in-app notice. continued use of the platform after an update constitutes acceptance of the revised terms.

these terms are governed by the laws of the state of delaware, without regard to its conflict-of-law principles. disputes will be resolved in the state or federal courts located in delaware.
